Mentioning Phensedyl syrup a ‘drug’, SC issues ban

The Appellate Division has issued a ban on carrying Phensedyl syrup mentioning it a ‘drug’.

The bench, headed by Chief Justice Hasan Foez Siddique, passed the order on Tuesday.

Badal Pal in Sadar upazila of Jhenidah district was arrested with 250 bottles of Phensedyl syrup in 1997. For this, in 2000, he was jailed for life time.

Later, the High Court has acquitted Badal following an appeal filed against the trial court verdict.

The HC then said as per the Narcotics Control Act, to carry Phensedyl syrup is not a crime. The state lawyers filed another appeal to the Appellate Division challenging the HC verdict.

After hearing on the appeal petition, the Appellate Division today upheld the trial court verdict.

And at the same time, the court said, “Phensedyl is a drug and to carry this drug is illegal.”

Deputy Attorney General Bishwajit Devnath said, ” Codeine which is used in the Phensedyl syrup, is a drug.
